Terms of Use (EULA)

This End User License Agreement ("EULA" or "Terms") is a legal agreement between you and GolfMore LLC ("Company," "we," "us," or "our") governing your use of the GolfMore mobile application (the "App") and related services.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License Grant

We grant you a non-transferable, non-exclusive, non-sublicensable, revocable license to install and use the App on any Apple-branded device that you own or control, as permitted by the Apple App Store Terms of Service. This license does not allow you to use the App on any device you do not own or control, except that the App may be accessed by other accounts associated with you via Family Sharing or volume purchasing.

2. License Restrictions

You may not:

• Share, sell, rent, lend, lease, or redistribute the App to third parties (unless allowed by Apple's Terms and Conditions and with our prior written consent).
• Reverse engineer, translate, disassemble, decompile, or attempt to derive the source code of the App or any part thereof, except with our prior written consent.
• Copy or alter the App (unless allowed by this license and the Apple Usage Rules). You may create and store backup copies only on devices that you own or control.
• Remove any intellectual property notices from the App or any copies thereof.

Violations of these restrictions, as well as the attempt of such infringement, may be subject to prosecution and damages.

3. Updates

This license governs any updates of the App provided by us that replace, repair, or supplement the original App, unless a separate license is provided for such update.

4. Technical Requirements

The App requires iOS firmware version 1.0.0 or higher. We recommend using the latest version of iOS. We will attempt to keep the App updated to comply with modified and new versions of iOS and new hardware. It is your responsibility to confirm that your device satisfies these technical specifications. We reserve the right to modify the technical specifications at any time.

5. Account Registration

To use the App, you must create an account by providing your name, email address, and a password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to update it as needed.

6. User-Generated Content and Community Guidelines

The App allows you to create and share content, including match posts, chat messages, profile information, and other user-generated content ("User Content"). By posting User Content, you represent and warrant that:

• You own or have the necessary rights to post the content.
• The content does not violate any applicable law or regulation.
• The content is not objectionable, abusive, harassing, threatening, defamatory, obscene, or otherwise inappropriate.

Prohibited Content and Behavior: The following are strictly prohibited:

• Harassment, bullying, threats, or intimidation of any kind
• Hate speech, discrimination, or content targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
• Sexually explicit or suggestive content
• Violent or graphic content
• Spam, scams, phishing, or misleading content
• Impersonation of other individuals
• Content that promotes illegal activities
• Any content that violates the rights of others

7. Content Moderation and Reporting

We are committed to maintaining a safe and respectful community. The App includes the following safety features:

• Report Content: You can flag any match post, message, or user profile that contains objectionable content by tapping the options menu (⋯) on any match card in the feed, on any user's profile page, or on any message in chat. Reports are reviewed by our team within 24 hours.
• Block Users: You can block any user at any time from their profile page or from a match card in the feed. Blocking a user will immediately remove all of their content from your feed, prevent them from contacting you, and notify our moderation team to review the blocked user's activity.
• Content Removal: We reserve the right to remove any User Content that violates these Terms or our Community Guidelines at any time, without prior notice.
• Account Termination: Users who violate these Terms may have their accounts suspended or permanently terminated at our sole discretion.

If you encounter objectionable content or abusive behavior, please report it immediately using the in-app reporting tools or by emailing golfmoreltd@gmail.com.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and share your personal information. By using the App, you consent to the practices described in the Privacy Policy.

9. Intellectual Property

The App and all of its content, features, and functionality (including but not limited to software, text, graphics, logos, and icons) are owned by GolfMore LLC and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms should be interpreted to restrict third-party terms. When using the App, you must comply with applicable third-party terms and conditions.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GOLFMORE LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

12. Indemnification

You agree to indemnify, defend, and hold harmless GolfMore LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the App, your User Content, or your violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the App at any time, with or without cause, with or without notice. Upon termination, your license to use the App will immediately cease. You may also delete your account at any time through the Account Settings screen in the App.

14. Modifications to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.
